CONDITIONS OF ENTRY

  1. Information on how to enter and prizes forms part of these Conditions of Entry. Entry into this promotion is deemed to be acceptance of these Conditions of Entry and prizes will be provided in accordance with and subject to these Conditions of Entry.
  2. Entry is only open to Australian residents aged 18 years and over. Employees (and their immediate families) of the Promoter, its associated companies, advertising agencies and participating retailers are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
  3. The Promotion commences on 18/08/10 and closes 11:59pm AEST on 15/09/10 (Promotional Period).
  4. To enter, individuals must, during the Promotional Period, purchase any Gillette product from a participating Coles supermarket (excluding Coles Express and Coles Central) in Australia or via Coles Online and log on to www.gillette.com.au follow the prompts, fully complete the online entry form including the last 4 digits from the product barcode(s) and the entire receipt number (if purchased at a participating Coles store in person) or input the requested details including their email address used for Coles online registration (if purchased via Coles online) and submit the entry form.
  5. Entrants who make a purchase at a Coles store must retain a copy/original of their product barcode(s) in order to complete the entry form. Entrants who make a purchase at a Coles store must also retain a photocopy of their purchase receipt(s) for all entries as proof of purchase. Failure to provide this proof of purchase for all entries when requested may, in the absolute discretion of the Promoter result in invalidation of ALL of an entrant's entries and forfeiture of any right to a prize. Purchase receipt(s) must clearly specify the store of purchase and that the purchase was made during the Promotional Period but prior to entry.
  6. Multiple entries will be accepted but: (a) each entry MUST relate to the purchase of a separate Gillette product; (b) only one entry is permitted for each participating Gillette product purchased; and (c) each entry must be submitted separately and in accordance with entry requirements. Upon request by the Promoter, individuals who make a purchase at a Coles store must provide a photocopy of their purchase receipt for each entry submitted in order to claim a prize.
  7. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant's identity, age and place of residence) and to disqualify any entrant who the Promoter believes either has tampered with the entry process or has submitted an entry which is not in accordance with these Conditions of Entry or acts in a disruptive manner or acts with the intent to annoy, abuse, threaten or harass any other person. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
  8. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant, or reject the entry.
  9. Incomplete, indecipherable or illegible entries will be deemed invalid.
  10. No responsibility is accepted for late, lost, incomplete, incorrectly submitted, delayed or misdirected entries. Proof of posting of purchase receipt(s) (if purchase receipt(s) are requested by the Promoter) is not proof of receipt.
  11. The Major and Minor Prize draws will take place at 10:00am AEST at Digital Stampede, 106 Alexander Street, Crows Nest, NSW 2065 on 17/09/10. Winners will be contacted by phone and in writing (by mail) and have their name and postcode published in The Australian on 20/09/10.
  12. Major Prize: The first valid entry randomly drawn from all entries received will be deemed the Major Prize Winner and will win the "Event Prize" which consists of: two (2) x September Club Tickets (including a pre-game lunch for two (2) people; two (2) x 2010 AFL Grand Final premium reserved seat tickets; and two (2) x tickets to post-match function); return flights for the Major Prize Winner and his/her companion from the Major Prize Winner's nearest capital city to Melbourne (if necessary) including all airline and airport taxes; return private car airport/hotel transfers; two (2) nights four (4) star accommodation at Citigate Melbourne (or similar) in a standard room, twin share; and return private car transfers from hotel to MCG. If the Major Prize Winner resides in Victoria, flights do not form part of the prize package, and flights cannot be redeemed for cash.

    The Major Prize Winner will also have the opportunity to participate in the Game for their chance to win $50,000 cash. If the Major Prize Winner cannot attend the event, or participate in the Game, a representative of the Promoter, known as the 'proxy' will play the game on behalf of the Major Prize Winner, provided that the Major Prize Winner gives the Promoter signed, written notice to that effect two business days before the start of the Game. The Promoter will supply the underwriters with a list of forty (40) randomly selected male and female Procter and Gamble employees with first initial and last name i.e. G. Robinson two working days prior to the Game. The underwriters will randomly pick five (5) names that will form the proxy list. On the day of the Game, the Major Prize winner who cannot attend/participate in the Game will pick one (1) person from the 'Proxy List' and they will play the Game on their behalf ("Proxy"). In the event that the Promoter has not been able to contact the Major Prize Winner before the commencement of the Game, a Proxy from the Proxy List will be appointed to play the Game on the Major Prize Winner's behalf. In any event, either the Major Prize Winner or a Proxy will play the game ("Participant") on the behalf of the Major Prize Winner. All Proxy's must meet the Terms and Conditions of the promotion.
  13. Prize must be taken on the dates specified by the Promoter to coincide with the 2010 AFL Grand Final, and is subject to booking and flight availability. Itinerary to be determined by the Promoter in its absolute discretion. No portion of the prize is redeemable for cash. The prize is non-refundable or transferable. In the event that any companion of the Major Prize Winner is under the age of 18 years, they must be accompanied by a parent/guardian at all times during the prize trip. Major Prize Winner is responsible for any amendments fees issued by airlines or suppliers once booking is confirmed and ticketed. Spending money, meals, taxes, transfers, items of a personal nature (including but not limited to in-room charges), insurance and any applicable insurance excesses, and any other ancillary costs not listed in the travel prize package description above are the responsibility of the Major Prize Winner and his/her nominated travelling companion as incurred. It is the Major Prize Winner's responsibility to organise transport to/from the airport departure/return point. The Major Prize Winner is responsible for ensuring they have any requisite travel documentation. Frequent flyer points will not form part of the prize. Prize is subject to the standard terms and conditions of individual prize and service providers. Winner may be required to present credit card at time of accommodation check in. It is a condition of accepting this prize that the Major Prize Winner and his/her companion must sign a release and exclusion of liability form (provided by the Promoter) in favour of all parties involved in this competition and/or providing the prize prior to undertaking the activities included in the prize. If the Major Prize Winner and/or their nominated companion do not sign the release form provided by the Promoter within the time requested by the Promoter, the Major Prize Winner's entry or claim will be deemed invalid. Major Prize is valued at up to $57,790.00 depending on point of departure.
  14. The Game: The Game will take place at the MCG during half time of the AFL Grand Final on 25/09/10. The Game involves the Participant: (a) starting from behind the 50 metre line on the AFL football field; and (b) drop punting (dropping the ball from the hands and kicked without touching the ground) an AFL ball, as provided by the Promoter allowing one bounce (after being kicked), through the middle of two centre main goal posts. The ball must pass through the two centre main goal posts either on the full or bouncing only once prior to passing through the middle of the goal posts. No part of the of the Participant's body or clothing may come in contact with the 50 metre demarcation line prior to kick. Any such contact shall constitute a foul and the Participant will be considered disqualified. If the Participant kicks the ball after the 50 metre demarcation line he/she will also be considered disqualified. If the Participant is successful at kicking the ball through the two centre main goal posts, subject to verification by the judges the Major Prize Winner will win $50,000 cash. The $50,000 cash prize will be awarded in the form of a cheque. If the Participant misses the goal (i.e. does not kick the ball between the middle of the two centre main goal posts or the ball bounces more than once prior to passing through the main goal posts), then the $50,000 prize will not be given away and, subject to verification by the Promoter, the Major Prize Winner will win $10,000 cash, awarded in the form of a cheque.
  15. The following classes of people shall be INELIGIBLE to participate in the Game:
    a) Current or former professional and semi-professional football, soccer, rugby or AFL players or at that level anywhere in the world;
    b) Current or former university and Olympic football, soccer, rugby or AFL players who have played at that level anywhere in the world within the past five (5) years; and
    c) Current or former employees, family members, agents, successors, or assignees of the Promoter or any promotional agency involved with this promotion (unless selected as a Proxy).
  16. The Game event Participant shall not be permitted any practice, warm-up, qualifying kicks, or coaching at the MCG at any time after his/her notification of participation in the promotion until the actual Game event football kick.
  17. Minor Prize: The next five (5) valid entries selected from all entries received will each win subject to the below, one 2011 Silver AFL Membership for an AFL club of their choice and a $200 Official AFL merchandise pack including: guernsey, scarf and beanie for the AFL club supported/chosen by the winner ("Minor Prize").

    The 2011 Silver AFL Membership for an AFL club of their choice includes:

    • access to 40 matches of the winner's choice in any combination at the MCG and Etihad Stadium;
    • access to all home matches of winner's club of support (regardless of venue);
    • a club membership number;
    • a club membership fulfilment pack (including club sticker, lanyard and cardholder. Exact inclusions in fulfilment pack are club-dependent) ;
    • $131 paid directly to the winner's club of support;
    • access to all NAB Cup matches and finals;
    • access to matches played in Victoria in weeks 1 & 2 of the finals series; and
    • access to purchase guest passes and access to reserved seating in the MCG AFL Reserve for international cricket matches (2010/2011 summer).

    Entry to all games is subject to capacity. Membership does not guarantee entry. Access to all home matches of the winner's club of support covers the cost of entry for the winner at home matches.

    Individual grounds/clubs determine seating requirements and may require a winner to reserve a seat at an additional cost (seasonally through the winner's club of support or on a per match basis through a nominated ticketing agency). Club home matches are included in the winner's 40 home and away game entitlement.

    Due to an extensive reserved seat wait list, West Coast Eagles membership is not available to residents of WA (unless the winner currently holds a club reserved seat package).
    Minor prize is valued at RRP $800 each. Any costs in excess of the value of the Minor Prize and all ancillary costs associated with redeeming the prize are the responsibility of the winner.
  18. A draw for the Major Prize, if unclaimed, may take place on 21/09/10 at the same time and place as the original draw, subject to any directions from a regulatory authority. The winner's name will be published in The Australian on 23/09/10.
  19. In the event of a Minor Prize not being accepted or claimed within three months of the original draw, the relevant Minor Prize winner's entry will be deemed invalid and the Promoter reserves the right to conduct such unclaimed prize draws at the same time and place as the original draw as are necessary on 11/01/11 to distribute any unclaimed Minor Prizes, subject to the written directions given by any relevant authority. Any winners in the unclaimed prize draw will be notified by the Promoter by telephone and in writing (by mail) and have their names published in The Australian newspaper on 25/01/11.


    GENERAL CONDITIONS

  20. Total prize pool is valued at up to RRP $61,790.00.
  21. The Promoter's decision is final and no correspondence will be entered into.
  22. The Major prize will be awarded only to the Major Prize Winner and not to a proxy. Each winner must allow up to 28 days for issue of prizes.
  23. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.
  24. Prize values stated are correct at time of printing. All prize values (or where relevant, possible maximum value), are in Australian dollars and inclusive of GST. The Promoter takes no responsibility for any variation in prize values.
  25. Unless expressly stated within these Conditions of Entry, all expenses are the responsibility of the winner.
  26. In the event that a prize is not available, the Promoter reserves the right to substitute a prize in it's discretion to the same and equal recommended retail value and/or specification, subject to any written directions from the various Lottery Departments.
  27. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Conditions of Entry; (e) any tax liability incurred by a winner or entrant; or (f) use of a prize/participation at the Game event.
  28. It is strongly recommended in relation to the taking of the Major Prize that the winner take out full travel and medical insurance cover for themselves. The Promoter will not be arranging or providing any such cover and is not liable to itself provide any such cover or to meet any expense or cost associated with cancellation, delay, missed connections, death, injury or ill health whilst the winner is enjoying the prize or associated with damaged or lost baggage or any other loss, expense, injury, illness or damage that may be suffered or incurred, nor to pay for or contribute to the costs of any such cover.
  29. As a condition of accepting the prize, the winner and/or the Participant's proxy (and any companion) must sign any legal documentation as and in the form required by the Promoter and/or organisers in their absolute discretion, including but not limited to a legal release and indemnity form.
  30. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
  31. Any cost associated with accessing the promotional website is the entrant's responsibility and is dependent on the Internet service provider used.
  32. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
  33. In the event of war, terrorism, state of emergency or disaster the Promoter reserves the right to cancel, terminate, modify or suspend the promotion subject to any written directions from the various lottery Departments.
  34. The Promoter collects entrants' personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including, but not limited to, prize suppliers and as required, to Australian regulatory authorities. If the information requested is not provided, the entrant may not participate in the promotion. By entering the promotion, unless otherwise advised, each entrant also agrees that the Promoter may also use this information, in any media for future promotional, marketing and publicity purposes without any further reference, payment or other compensation to the entrant, including sending the entrant electronic messages. A request to access, update or correct any information should be directed to the Promoter at their address set out below. All entries become the property of the Promoter.
  35. Entrants consent to the Promoter and it's agencies, using the entrant's name, likeness, image and/or voice in the event they are a winner (incl. photograph, film and/or recording of the same) in any media for an unlimited period of time without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
  36. The Promoter accepts no responsibility for any tax implications that may arise from the prize winnings. Independent financial advice should be sought.
  37. The Promoter reserves the right to request winners to provide proof of age, identity and residency prior to awarding any prize. Identification considered suitable for verification is at the discretion of the Promoter.
  38. The Promoter reserves the right to change these Conditions of Entry, and to make and publish interpretations of these Conditions of Entry, without prior notice, subject always to any written directions from any Australian regulatory authority.
  39. The Promoter does not necessarily adopt or endorse, and does not accept any liability for, any statements or claims that are made by any retailer or partner or associate, or website content that is posted on retailer or partner or associate sites.
  40. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

  42. The Promotion is offered in Australia only and is governed by the laws applicable in Australia. In case of any disputes, participants in the promotion consent to the jurisdiction of the courts in Australia.
